Terms of Service

1. Acceptance of Terms
By accessing or using Screend (“the Service”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
2. Description of Service
Screend is a privacy-first verification platform. We store your verification status only (verified, expired, or revoked) — never test results or health records. Verified users receive a digital badge that can be shared via QR code or link.
3. User Accounts
You must provide a valid email address to create an account. You are responsible for maintaining the confidentiality of your account credentials. You must be at least 18 years of age to use the Service.
4. Verification Process
Screend facilitates verification of STI screening status through licensed healthcare providers (“Issuers”). By using this Service, you acknowledge and agree that:
4.1 Verification Limitations
- A Screend verification badge indicates that an approved Issuer has confirmed your STI screening status at a specific point in time.
- Verification is NOT a guarantee of current health status. STI status can change at any time after testing.
- The Service does not replace ongoing health monitoring, regular testing, or medical consultation.
- Badge expiry (90 days) is a system default and does not constitute medical advice about testing frequency.
4.2 Issuer Independence
- Issuers are independent healthcare providers, not employees or agents of Screend.
- Screend does not supervise, direct, or control the clinical judgment or verification decisions of Issuers.
- Screend is not responsible for errors, omissions, or misconduct by Issuers.
4.3 Identity Verification
- You are solely responsible for the accuracy of information provided during registration and verification.
- Sharing your verification code with another person, or using another person’s code, is a violation of these Terms and may result in immediate account termination.
- Screend implements technical measures to verify identity but cannot guarantee absolute prevention of fraud or impersonation.
4.4 Remote Verification
- When using telehealth or remote verification methods, additional identity confirmation steps may be required.
- You consent to receiving push notifications for verification confirmation when using remote services.
- Network delays or technical issues may affect real-time verification; Screend is not liable for verification delays.
5. Privacy
Your privacy is fundamental to our service. Please review our Privacy Policy for details on how we handle your data.
6. Sharing
When you share your verification status, you consent to the recipient viewing the information included in the share. You control what information is shared and can revoke any share at any time.
7. Subscriptions & Payments
Some features require an active subscription. Payments are processed securely through Stripe. You may cancel your subscription at any time. Refunds are handled in accordance with Australian Consumer Law.
8. Account Deletion
You may delete your account at any time through Settings. Upon deletion, your personal data is anonymized and your shares are deactivated. Audit logs are retained as required by law.
9. Limitation of Liability
9.1 No Medical Advice
Screend is a technology platform, not a healthcare provider. The Service does not provide medical advice, diagnosis, or treatment. Nothing in this Service should be construed as medical advice.
9.2 No Health Guarantees
To the maximum extent permitted by law:
- Screend makes no representations or warranties regarding the health status of any user, verified or otherwise.
- A verification badge is an indication that testing occurred, not a guarantee of disease-free status.
- Screend is not liable for any health outcomes, transmission of disease, or medical conditions arising from reliance on verification status.
9.3 User Decisions
You acknowledge that:
- Decisions regarding sexual health, partner selection, and protective measures are your sole responsibility.
- Screend verification is one factor among many that should inform health decisions.
- You should not rely solely on Screend verification when making decisions that affect your health or safety.
9.4 Limitation of Damages
To the maximum extent permitted by Australian law:
- Screend’s total liability for any claims arising from your use of the Service is limited to the amount you paid for the Service in the 12 months preceding the claim, or AUD $50, whichever is greater.
- Screend is not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of health, emotional distress, or medical expenses.
- These limitations apply regardless of the theory of liability (contract, tort, strict liability, or otherwise).
9.5 Indemnification
You agree to indemnify and hold harmless Screend, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any rights of another person
- Any claim that your use of the Service caused damage to a third party
10. Changes to Terms
We may update these terms from time to time. We will notify you of material changes via email or in-app notification. Continued use after changes constitutes acceptance.
11. Governing Law
These terms are governed by the laws of Victoria, Australia.
12. Acknowledgment of Risk
By using Screend, you expressly acknowledge and agree that:
- Testing Window Periods. STI tests have window periods during which infections may not be detectable. A negative test does not guarantee absence of infection.
- Time Lag. There is inherently a time lag between testing, result availability, and verification. Status may change during this period.
- Partial Information. Verification may cover specific tests (e.g., full panel, partial panel) and does not represent comprehensive health screening.
- No Substitute for Communication. Screend verification does not replace direct communication with partners about sexual health history, practices, and preferences.
- Ongoing Risk. Sexual activity carries inherent health risks that cannot be eliminated by any verification system.
- Technology Limitations. No technology platform can guarantee 100% accuracy, availability, or security.
By creating an account, you confirm that you have read, understood, and agree to these limitations and acknowledgments.
13. Dispute Resolution
13.1 Informal Resolution
Before initiating formal proceedings, you agree to contact Screend at legal@screend.app to attempt informal resolution. Most concerns can be resolved this way.
13.2 Jurisdiction
These Terms are governed by the laws of Victoria, Australia. Any disputes shall be resolved in the courts of Victoria, Australia.
13.3 Class Action Waiver
To the extent permitted by law, you agree to resolve disputes on an individual basis and waive any right to participate in a class action lawsuit or class-wide arbitration.
